Согласие на обработку персональных данных

Это согласие вы даёте, когда создаёте аккаунт в приложении «Parella» (прежнее название — «You & Me») — на телефоне, в веб-версии или внутри Telegram. Даёте свободно, своей волей и в своём интересе, как требует статья 9 закона «О персональных данных» (№ 152-ФЗ). Здесь — главное, по пунктам; подробно о том, что происходит с данными, — в политике конфиденциальности.

1. Кому вы даёте согласие

Оператору персональных данных — Ефанову Михаилу Александровичу, физическому лицу, автору приложения. Почта для любых вопросов о ваших данных и для отзыва согласия: [email protected].

Даты месячных и подсказки к дням цикла (это данные о здоровье) и отметки «Вдвоём» (данные об интимной жизни) это согласие не охватывает. На них приложение спрашивает отдельное согласие — перед первой записью, в самом календаре цикла и в «Вдвоём».

4. Что мы делаем с данными

Собираем, записываем, систематизируем, накапливаем, храним, уточняем (обновляем, изменяем), извлекаем, используем, передаём (предоставляем и открываем доступ) вашему партнёру по паре и получателям из пункта 6, обезличиваем, блокируем, удаляем и уничтожаем. Обработка автоматизированная: данные лежат в базе и передаются через интернет по защищённому соединению (TLS).

5. Где хранятся

В России. База данных — на сервере, который мы арендуем в дата-центре ООО «Бегет» в Санкт-Петербурге, файлы — в хранилище того же провайдера, тоже в России.

6. Кому передаём

Вашему партнёру по паре — всё общее пространство пары, как в приложении. Кроме него:

Это согласие распространяется и на передачу за границу этим получателям. Законы о персональных данных в этих странах не такие, как в России, и защищают данные по-своему. Что именно уходит каждому получателю — в политике, в разделе «Передача за границу». Уведомления выключаются в настройках телефона, а помощник и бот получают что-то, только когда вы сами к ним обращаетесь.

7. Сколько действует

Пока у вас есть аккаунт — до его удаления или до отзыва согласия. После этого мы удаляем ваши данные: при удалении аккаунта — сразу, при отзыве письмом — обычно в течение 7 дней, не позже чем через 30 дней. Из резервных копий, которые нужны на случай сбоя, удалённое уходит не позже чем через 6 месяцев. Остаются записи об оплатах Плюса и служебные записи о выданных кодах и приглашениях: они нужны для учёта и возвратов, вашего содержимого в них нет.

Отдельно от согласия закон обязывает хранить сообщения и после их удаления — 6 месяцев, а сведения о них и о вас — 3 года (Федеральный закон № 149-ФЗ, ст. 10.1, п. 3; согласия это хранение не требует, и отзыв согласия его не прекращает). Копия закрыта: ни вы, ни партнёр её не видите; мы передаём её только по законному требованию уполномоченных государственных органов и ни для чего другого не используем, а по истечении срока сервер стирает её сам. Что именно хранится — в политике.

8. Как отозвать

Напишите на [email protected] с адреса, на который зарегистрирован аккаунт, или удалите аккаунт кнопкой «Удалить аккаунт» в самом приложении («Настройки → Данные и аккаунт», внизу экрана; если строки «Данные и аккаунт» нет — в самом низу настроек). Без этого согласия приложение работать не может, поэтому после отзыва аккаунт удаляется вместе с данными — кроме того, что закон велит хранить (пункт 7). Отзыв не отменяет того, что было сделано с данными до него. Не отзывая это согласие, можно выключить статистику, новости и Карту мест (место и время съёмки ваших фото и места, поставленные вами вручную, при этом сразу стираются), а календарь цикла и отметки «Вдвоём» — удалить; как — сказано в политике.

Consent to the processing of personal data

You give this consent when you create an account in Parella (formerly You & Me) — on a phone, in the web version or inside Telegram. You give it freely, of your own will and in your own interest, as Article 9 of the Russian law “On Personal Data” (No. 152-FZ) requires. Here is the gist, point by point; the privacy policy describes in detail what happens to the data.

1. Who you give the consent to

The operator of personal data — Mikhail Aleksandrovich Efanov, a private individual and the author of the app. The address for any question about your data and for withdrawing the consent: [email protected].

Period dates and your own notes on cycle days (health data) and “Just us” marks (data about your intimate life) are not covered by this consent. For those the app asks for a separate consent — before the first entry, in the cycle calendar and in “Just us” themselves.

4. What we do with the data

We collect, record, organise, accumulate, store, clarify (update, change), retrieve, use and transfer it (provide it and give access to it) — to your partner in the couple and to the recipients in section 6 — and we anonymise, block, delete and destroy it. The processing is automated: the data is kept in a database and travels over the internet through an encrypted connection (TLS).

5. Where it is kept

In Russia. The database lives on a server we rent in a data centre of Beget LLC in Saint Petersburg; files are kept in the same provider’s storage, also in Russia.

6. Who receives it

Your partner in the couple — the whole shared space of the couple, as in the app. Besides them:

By giving the consent you also agree to this transfer abroad. The personal data laws of these countries are not the same as Russia’s, and they protect data in their own way. What exactly goes to each recipient is in the policy, under “Transfers abroad”. Notifications can be switched off in your phone’s settings, and the assistant and the bot only get something when you turn to them yourself.

7. How long it lasts

As long as you have an account — until you delete it or withdraw the consent. After that we delete your data: at once if you delete the account, and if you withdraw by e-mail — usually within 7 days and no later than 30 days after your letter. Deleted data leaves the backups, which exist in case of a failure, within 6 months. The records of Plus payments and the service records of issued codes and invitations remain: they are needed for accounting and refunds, and they contain none of your content.

Separately from the consent, the law requires us to keep messages for 6 months after they are deleted, and records about them and about you for 3 years (Russian Federal Law No. 149-FZ, Article 10.1, Clause 3; this storage does not need consent, and withdrawing the consent does not end it). The copy is locked: neither you nor your partner can see it; we hand it over only on a lawful demand of the authorised state bodies and use it for nothing else, and when the period ends the server erases it by itself. What exactly is kept is in the policy.

8. How to withdraw it

Write to [email protected] from the address your account is registered to, or delete your account with the “Delete account” button, right in the app (Settings → Data and account, at the bottom of the screen; if there is no Data and account row, at the very bottom of Settings). The app cannot work without this consent, so after a withdrawal the account is deleted along with the data — except what the law requires us to keep (section 7). A withdrawal does not undo what was done before it. Without withdrawing this consent, you can switch off statistics, news and the Places map (the places and times of your photos and the places you set by hand are then erased right away) and delete the cycle calendar and the “Just us” marks — the policy says how.
